1. Acceptance of Terms

By creating an account or using AVAEVO - ClickScape ("the Game"), you agree to these Terms & Conditions. If you do not agree, do not use the Game.

2. Eligibility

You must be at least 13 years of age to create an account and use the Game. By registering, you confirm that you are 13 years or older. Users under 18 should have parental or guardian consent.

3. Account Rules

You are responsible for maintaining the security of your account credentials.
One account per person. Creating multiple accounts to exploit game mechanics is prohibited.
You may not share, sell, or transfer your account to another person.
You must provide a valid email address for account recovery purposes.

4. Fair Play & Anti-Cheat

Use of automated tools, bots, macros, or autoclickers is strictly prohibited.
Exploiting bugs or glitches for unfair advantage is prohibited. Report bugs to support@avaevo.com.
Modifying game data, network requests, or client code to gain advantages is prohibited.
Accounts flagged for cheating may be temporarily or permanently banned without prior notice.
Players detected by our anti-cheat systems will be excluded from leaderboards and PVP tournaments.

5. In-Game Purchases

The Game offers optional premium items for purchase using real currency via Stripe.
All purchases are final. No refunds will be issued once a digital item has been delivered to your account.
Prices are displayed in EUR and include applicable taxes.
We reserve the right to change prices or availability of premium items at any time.
If a purchase fails to deliver due to a technical error, contact support@avaevo.com for resolution.

6. Virtual Items & Currency

All in-game items, currency (Euros), equipment, and progress are virtual and have no real-world monetary value.
We do not support or endorse real-money trading (RMT) of in-game items between players.
We reserve the right to modify, rebalance, or remove any in-game items or features at any time.

7. PVP Tournaments

Tournament results are determined by automated combat simulation based on player stats.
Tournament rewards are distributed automatically upon completion.
We reserve the right to disqualify players suspected of cheating from tournaments.

8. Account Termination

We may suspend or terminate accounts that violate these Terms.
Reasons for termination include but are not limited to: cheating, harassment, fraud, or abuse.
You may delete your account at any time by contacting support@avaevo.com.
Upon termination, all game progress and purchased items are forfeited.

9. Service Availability

The Game is provided "as is" without guarantees of uptime or availability.
We may perform maintenance, updates, or changes that temporarily affect access.
We are not liable for lost progress due to server issues, though we make reasonable efforts to prevent data loss through cloud saves.

10. Intellectual Property

AVAEVO - ClickScape, including all game code, assets, mechanics, and content, is the intellectual property of Evolets / Avascon. You may not copy, distribute, modify, or create derivative works based on the Game without written permission.

11. Limitation of Liability

To the maximum extent permitted by law, Evolets / Avascon shall not be liable for any indirect, incidental, or consequential damages arising from use of the Game. Our total liability shall not exceed the amount paid by you for premium purchases in the 12 months prior to the claim.

12. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes shall be resolved in the courts of the Netherlands.

13. Changes to Terms

We may update these Terms at any time. Continued use of the Game after changes constitutes acceptance of the new Terms. We will notify users of significant changes via in-game notification or email.

2. What Data We Collect

Account data: Username, email address, hashed password (we cannot see your actual password)
Game data: Skill levels, inventory, equipment, achievements, tournament history
Technical data: IP address (for rate limiting and anti-cheat), login timestamps
Purchase data: Transaction records, items purchased (payment details are handled by Stripe and never stored on our servers)

3. How We Use Your Data

To provide and operate the Game (cloud saves, leaderboards, PVP)
To authenticate your identity and secure your account
To process purchases via Stripe
To send password reset emails when requested
To detect and prevent cheating
To generate anonymized statistics (total players, active tournaments)

4. We Do NOT

Sell or share your personal data with third parties for marketing
Send marketing emails or newsletters (only transactional emails like password resets)
Track you across other websites
Store payment card details (Stripe handles all payment processing)

5. Data Storage & Security

Your data is stored on a private server located in the Netherlands
Passwords are hashed using bcrypt (industry standard, irreversible)
All connections use HTTPS/TLS encryption
Access to the database is restricted and protected

6. Data Retention

Account data is retained as long as your account is active
If you request account deletion, all personal data is permanently removed within 30 days
Purchase records may be retained for legal/tax purposes for up to 7 years

7. Your Rights (GDPR)

As an EU resident, you have the right to:

Access: Request a copy of all data we hold about you
Rectification: Correct inaccurate data
Erasure: Request deletion of your account and data
Portability: Receive your data in a machine-readable format
Object: Object to certain processing of your data

To exercise these rights, email support@avaevo.com. We will respond within 30 days.

8. Cookies & Local Storage

We use browser localStorage to cache your game session locally (performance backup)
We store a JWT authentication token to keep you logged in
We do not use tracking cookies, analytics cookies, or advertising cookies
No third-party cookies are set by our Game

9. Third-Party Services

Stripe: Payment processing. Subject to Stripe's Privacy Policy
Strato: Email delivery for password resets

10. Children

The Game is not intended for children under 13. We do not knowingly collect data from children under 13. If we become aware that a user is under 13, we will delete their account.

11. Changes

We may update this Privacy Policy. Changes will be posted on this page with an updated date.
